1. DO NOT: Use your account to Host or transmit; illegal, copyright infringing, obscene, indecent, inflammatory, or pornographic material sites or files. This includes any visual or text advertisements for any obscene, indecent, inflammatory or pornographic material sites also. If you are found to be breaching this term, your account may be suspended or terminated.

2. DO NOT: Upload malcious Server applications, executables, dlls, viruses/worms, tools, trojans, of any nature. If logs reveal an attempt to compromise security or damage this server or others. 3 things will happen - 1. Account Access Removed. 2. Logs and your details printed & Evidence Compiled. 3. Evidence sent to appropriate authorities including your ISP notified.

3. DO NOT: Use your account or mail services to send unsolicited electronic mail messages to anyone. Do not use hosted domain name(s) in any unsolicited messages emailed or posted anywhere which might cause annoyance. We will immediately suspend all network traffic for your account and mail services with an email sent to your registered email address with 48 hours to reply with your defense in relation to the complaint. After review, we reserve the right to immediately cancel without refund at our discretion.

4. DO NOT: SignUp for multiple Reseller Accounts unless you are approved by staff - Only one Account will be activated per user.

5. WEB SPACE AND DATA TRANSFER: All hosting accounts have a set amount of space and free data transfer per month as per your plans, users who need more you will need to upgrade their account to another plan. Accounts which go over their limit for data transfer (see below ) for any calendar month will be charged at NZ$0.02 (excl. GST) per Mb extra.

*Data Transfer is assigned per calendar month for each hosting account on your plans. It is measured exactly down to the byte and includes all hits, file/data transfers and traffic to and from (upstream and downstream) your web hosting accounts. Email and FTP Transfers are excluded from data transfer limits, and the FTP and Mail Server are not usage counted. However, abuse of the FTP Server or mail server by file serving or extensive unnecessary transfer will not be tolerated, and may result in restrictions being put in place.

6. Instaweb performs regular backups every 24 hours, and aims to maintain 99% Uptime. However, Instaweb is not responsible for any deletion, alteration, or loss of data due to network or system outages, file corruption, accidental deletion, or any other reasons. Instaweb makes no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such. Users are responsible for regularly monitoring and also creating backups of their own files, and agree to use Instaweb resources and infrastructure at their own risk.

10. MUST DO: Keep your account secure by not giving out your username or password.

11. MUST DO: Keep your account details current and accurate. Especially your email.

12. MUST DO: Check the Instaweb Status Page for Server Reports and scheduled downtimes.

13. MUST DO: Advise immediately of any access problems or security breaches.

14. MUST DO: Accept occasional mailings to your registered email address, including the Instaweb Newsletter, Instaweb Updates, promotions, and messages from our Associates.

15. MUST DO: Pay for any services where charges are incurred or fees are payable, and you are invoiced. Accounts failing to pay for charges incurred or fees payable will be Suspended after 14 Days from invoice due date and Terminated after 30 Days from invoice due date. Fees outstanding will be referred to our Dept Collection department and will be pursued, continued failure to pay will be reflected against credit rating agencies.

16. Money Back Guarantee

If you are unsatisfied with your services at Instaweb you may be eligible for a Refund if it has 30 days or less since you applied for the service you seek refund for.

Web Design customers may cancel their projects and are valid for a Full Refund if work commenced on your project 30 Days or less ago and you are not satisfied with progress.

Hosting Accounts may be removed in the control panel and will automatically issue a Full Refund if the account is 30 Days or less old and your account has incurred less than 25MB of data transfer.

Domain Registrations/Purchases are not valid for refund.

You are not eligible for any refund if your account was terminated or is still suspended due to a breach of these Terms of Use.

After 30 Days of activation has past, any refund is offered at our discretion.

17. For security reasons we may require you to re-authenticate yourself from time to time, for example after a period of inactivity on the connection between your browser/FTP Client and the Instaweb servers. We are not responsible for any information you may lose if the Instaweb servers terminate your browser/FTP Client session due to prolonged periods of inactivity

18. You indemnify us and our officers, employees, agents and related bodies corporate from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses arising out of or in any way connected to the use of Instaweb by you or someone using your name and password.

19. If, in Instaweb's reasonable opinion, you breach any of these Terms of Use, we may suspend, terminate or limit your access to Instaweb without refund. No negotiation will be entered into at anytime regarding refund or pro-rata refunds.

20. You may terminate your Instaweb Reseller or Close Hosting Account(s) at anytime, however if after 30 Days activation, any refund for hosting accounts is offered at our discretion. Any outstanding fee's will be invoiced to you.

21. All prices displayed and products and services offered to be supplied on Instaweb are subject to change without notice. The currency on Instaweb is NZ Dollars.

This Policy is subject to change at anytime. A Notice will be sent to all registered email addresses within 48 hours of any major changes.
